Goods in Transit Insurance and Warranty –
E-FARM as of June 2026
I. Goods in Transit Insurance
- E-FARM procures 'goods in transit' insurance for the buyer in respect of all machinery sold by or through E-FARM and transported to the buyer based on arrangements made by E-FARM on the buyer's request.
- The insurance costs (premium) are included in the invoiced transportation fee.
- The insured amount is the net purchase price of the sold machinery.
- The damage deductible on each occasion of damage shall be 1% of the insured amount, in any case at least EUR 500 per any such occasion.
- The insurance cover shall only extend to damages to the Goods occurred during transportation thereof. Unless explicitly stated otherwise, the applicable regulations shall be the German General Marine Insurance Rules (MIR/ADS) in the 1984 version (here in the coverage form 'Full Coverage' according to Clause 1.2) and additionally the DTV Cargo Insurance Terms of the German Insurance Association ('Gesamtverband der Deutschen Versicherungswirtschaft') in the 2011 version. The risks excluded according to Clauses 1.1.2.1, 1.1.2.2 and 1.1.2.4 of ADS 1984 are included in the insurance on the basis of the relevant DTV clauses.
- Explicitly excluded from the insurance are damages to paintwork, scratches and impact damages to the Goods.
- A Goods in Transit insurance does not cover any further damage claims. In particular any damage claims are excluded in case of late delivery.
- The insurance does not cover any damage attributable to premeditation or gross negligence on the part of the buyer.
II. Warranty

Buyers of tractors and combine harvesters sold by or through E-FARM, for which an official E-FARM inspection forms part of the sales contract, may procure an operability warranty for the purchased machinery for a specified term, as detailed in Clause 5 of this Section II. The warranty shall only be valid if such inspection has been carried out prior to handover by E-FARM or an entity commissioned by E-FARM, and the corresponding inspection report has been completed, reviewed, approved, and issued to the buyer by E-FARM.

The operability warranty set out in this agreement constitutes a contractual arrangement for discretionary repair cost participation. It does not constitute an insurance contract, insurance service, or the assumption or transfer of risk by E-FARM. Any participation in repair costs is subject to prior approval by E-FARM, case-by-case assessment, and compliance with the conditions set out in this agreement.

This warranty is available only for transactions within the European Economic Area (EEA).

The warranty applies only to machinery that meets both of the following conditions:
- Be no older than 10 years from the date of initial registration.
- Has not exceeded the following operational limits at the time of purchase:
- Tractors: 4,000 engine hours
- Combine Harvesters: 2,000 engine hours

Buyers can select from the following warranty term options:
- Tractors:
- 250 engine hours and/or 3 months (Basic Warranty)
- 500 engine hours and/or 6 months (Extended Warranty)
- Combine Harvesters:
- 100 engine hours and/or 3 months (Basic Warranty)
- 200 engine hours and/or 6 months (Extended Warranty)
- Tractors:

The warranty term begins on the invoice issuance date and expires upon reaching either the specified number of engine hours or the corresponding time period, whichever occurs first.

The warranty covers only components assessed as being in a 'satisfactory state' during the pre-purchase inspection.

Components initially assessed as not being in a 'satisfactory state' may be included in the warranty coverage if they are repaired before collection, with supporting evidence provided.

Warranty claims are valid only for operability losses occurring within the warranty term due to internal defects, excluding:
- Damages caused by external factors (e.g., collision, theft, fire, storm, flood, hail, or wildlife damage).
- Consequential losses such as crop shortfalls or replacement machinery costs.
- Wear and tear-related impairments, except for covered components. However, tires, tracks, chains, and brakes are explicitly excluded from wear-and-tear coverage.
Note: Any defects, failures, or damages relating to transmissions or transmission-related components are excluded from the warranty program.

If an operability issue arises, the buyer must notify E-FARM within 5 business days of discovery of the issue and prior to engaging any workshop.

Repairs must be conducted by an official authorized workshop within a radius of 150 km from the buyer's location, or if no such workshop is reasonably available, at the nearest suitable authorized workshop, subject to E-FARM's prior approval.

Before repairs commence, the buyer must submit the workshop's cost estimate to E-FARM for approval.

E-FARM may dispatch an expert to inspect the defective machinery before any repair work begins.

Only repairs pre-approved by E-FARM qualify for reimbursement.

If transportation is necessary, costs will be reimbursed only if transportation terms have been agreed upon in advance.

The authorized workshop must retain replaced parts for at least six months.

E-FARM will reimburse the buyer for approved repair costs excluding VAT, upon receipt of final invoices and proof of payment.

The maximum reimbursable amount (including transportation costs) is 25% of the net purchase price or €25,000 net (whichever is lower).

The buyer must cover a portion of the repair costs based on the machinery's engine hours at the time of purchase. The buyer's cost share is as follows:
- Tractors:
- Up to 1,000 engine hours: Buyer covers 20%
- Up to 2,000 engine hours: Buyer covers 30%
- Up to 3,000 engine hours: Buyer covers 40%
- Up to 4,000 engine hours: Buyer covers 50%
- Minimum buyer contribution: €2,000 net
- Combine Harvesters:
- Up to 250 engine hours: Buyer covers 20%
- Up to 500 engine hours: Buyer covers 30%
- Up to 1,000 engine hours: Buyer covers 40%
- Up to 2,000 engine hours: Buyer covers 50%
- Minimum buyer contribution: €3,000 net
- Tractors:
